1. The Rapsodo Golf “Go Fore Gold” Sweepstakes (the “Promotion” or “Sweepstakes”) is open to age 18+ legal residents of all participating countries and considered “Eligible Areas”. Employees, officers and directors of the Sponsor, its agents, administrators and creative entities, and anyone professionally associated with this Promotion, and anyone residing in the household of any of the foregoing (whether related or not) are excluded.

2. This Promotion is void outside the Eligibility Areas and where prohibited by law.

3. No purchase necessary; however, purchase may be required if an entrant does not already own a MLM2PRO™ device. Internet access, MLM2PRO Premium Membership.

4. Promotion Period: Enter between 12:00:00 AM CDT (12:00:00 AM EDT, 18:00:00 PM BST) on August 1, 2024 and 11:59:00 AM CDT (11:59:00 AM EDT, 17:59:00 AM BST) on August 12, 2024 inclusive (the “Promotion Period”).

5. To Enter: The promotion and one shared prize pool item can be obtained by use of playing nice holes on the Rapsodo Courses “2024 Olympics: Le Golf National Rapsodo” with an MLM2PRO™ device and having an active MLM2PRO Premium Membership. Additionally, rounds must fully sync your session to your Rapsodo online account during thePromotion Period:

a) Earn one entry for every nine holesplayed on the Rapsodo Virtual Course “2024 Olympics: LeGolf National Rapsodo”. No limit to number of entries. Each nine holeround on “2024 Olympics: Le Golf NationalRapsodo” counts as a separate entry.

6. There is a limit of one (1) prize per household. For actions 5 there is no limit on the number of entries per person during the Promotion Period.

7. Further Entry details:

a) Odds of Winning: Your odds of winning depend on the number of entries received. Entrants who obtain a higher number of entries to participate in the Sweepstakes have a greater chance of winning aPrize than Entrants who obtain a lower number of entries to participate in theSweepstakes.

b) See https://rapsodo.com/pages/golf for device and subscription details. By participating in the Sweepstakes using anMLM2PRO™ device, agree that your information associated with your Rapsodo MLM2 PRO Premium Membership is accurate, and that the Sponsor and its designees may use that information for the purpose of administering this Sweepstakes.

c) In the event of a dispute as to the identity of the entrant associated with any entry, the authorized accountholder of the email address associated with the entry, at time of submission, will be deemed to be the entrant. The “authorized account holder” is the natural person assigned to the email account by the applicable email account provider. Potential winner may be required to show proof of being the authorized account holder. In the event a dispute regarding the identity of the person who actually submitted an entry cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible. Normal Internet access and usage charges imposed by your online service will apply to online activity in connection with participation in the Sweepstakes using the internet. If you participate from your mobile phone, such activity will be subject to the charges pursuant to your wireless service provider’s rate plan.You further agree that by providing your mobile phone as part of your participation information, you are consenting to Sponsor or its designee contacting you via a live call or text message to your mobile phone if you area potential winner, which will be subject to the charges pursuant to your wireless service provider’s rate plan.

8) The Prizes: There will be a total of 14winners. Prizes will be randomly allocated, total ARV of all prizes: USD $3,840,

a) 2 winners will each win a 30 minute virtual lesson with Mark Blackburn. ARV per Prize: USD $500.

b) 4 winners will each win a Callaway RPT golf ball bundle, which include 6 x boxes of RPT golf balls. ARV per Prize: USD$210.

c) 2 winners will each win a “The Stack”set of golf swing speed training equipment, as further described at

www.thestacksystem.com/collections/us-products/products/thestack-adult-training-hardware. ARV per

Prize: USD $350.

d) 3 winners will each win a GPOD Magsafephone tripod. ARV per Prize: USD $75.

e) 3 winners will each win a Rapsodo GolfBag. ARV per Prize: USD $300.

9) Further Prize Details:

a) Virtual Lessons:

i) The lesson will take place online. The date and time are unconfirmed and will be determined during winner communications. The date and time are subject to change and are dependent onthe availability and schedule of Mark Blackburn.

ii) The Sponsor reserves the right tosubstitute a different professional golf instructor in its sole discretion.

iii) The lesson must be taken before January 31, 2025. The lessons are subject to the golf instructor’s availability. The Sponsor will endeavor to provide as much visibility as possible for thePrize date, although timings may only be confirmed (and are liable to move)days in advance, subject to the golf instructor’s availability. Neither the Sponsor nor the golf instructor will be liable in any way for any cancellation or postponement of the Prize.

iv) The lesson will take place on a datepre-determined by the golf instructor and Sponsor (with winners unable tochange). Winners may need to attend at short notice anytime from the point ofbeing confirmed as winner onwards.

v) The Prize will be arranged by email/phone between the Sponsor and the winner. The Sponsor will make all reasonable efforts to provide the winner with details of the Prize at the earliest possible opportunity. The Sponsor will have final discretion on all elements and aspects of how the Prize is organized. Once the Prize details including date and time are confirmed, this cannot be amended or altered by the winner.

vi) If for any reason the lesson is not capable of running as planned, such as cancellation or any other cause beyond the control of the Sponsor which affects the running or conduct of thisSweepstakes, the Sponsor may in its sole discretion cancel the Prize and notre-award the Prize to the winner or reimburse any incurred expenses by the winner as a result of winning or accepting the Prize.

vii) For the avoidance of doubt, the Prize does not include travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, excess baggage, additional excursions and attractions or any other costs of a personal nature (including pending money) that are not explicitly set out in these Official Rules(“Rules”) and neither the Sponsor nor any provider of any part of the Prize will be responsible for any such costs.

viii) The winner is responsible for the behavior of themselves whilst taking the Prize. The Sponsor reserves the right in its absolute discretion to exclude the winner from participation in any aspect ofthe Prize if any party fails to comply with the directions of the Sponsor orany companies associated with the Prize or if the winner acts in a manner thatis dangerous to themselves or to the public or is, in the opinion of theSponsor, anti-social in any manner or which causes a disturbance or nuisance to others. Failure to comply with these Terms and Conditions may result in the lesson being cancelled or stopped.

b) RPT Golf bundles, “The Stack” sets, and GPOD Mag safe phone tripods:

i) The Sponsor is not liable for any Prizes once distributed/dispatched to a winner and the Sponsor will not be responsible for any Prizes not received, broken or lost in transit.

ii) Any warranty is subject to the original manufacturer’s warranty period.

iii) By participating in the Promotion, entrants agree that the Prize is awarded on an "as is" basis, and that the Sponsor makes no representations or warranties of any nature with respect to the Prize. The winner is not recipient of a Prize until they have been verified and/or notified. Prize details are at Sponsor’s sole discretion. Winners acknowledge that the Sponsor and its agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions or fitness of any aspects of the Prizes except each Prize is subject to its manufacturer's standard warranty, if any.

10) Winner Selection: 14 provisional winners will be randomly selected from among all valid entries submitted during the Promotion Period and 14 working days of 23:59 CDT August 19, 2024.

11) Winner Notification: The provisional winners will be contacted via the email address or telephone number provided.All provisional winners will be contacted with in seven (7) working days ofWinner Selection and will be asked to provide evidence of identity and eligibility, and their written agreement to be bound by these Official Rules. Further, for residents of Canada, the notification email will include a mathematical skill-testing question, which the provisional winner must correctly answer via reply email as a condition of prize receipt. Reasonable efforts will be made to contact the provisional winners. Once eligibility has been confirmed, the provisional winners will be confirmed as winners. If a provisional winners does not respond to the initial contact within seven (7) days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

12) Upon the request of the Sponsor, any provisional winner may be required to complete and return a Declaration of Eligibility, Waiver of Liability and, except where prohibited by applicable law, Publicity Release Forms (collectively, the “Release Forms”) within five (5) working days after the date such Release Forms are sent to the potential winner, in accordance with theSponsor’s instructions. In the event that a provisional winner does not respond to the initial contact within seven(7) days or provide the Release Forms, as applicable, within the requested time period, the Sponsor reserves the right to disqualify that provisional winner. If a provisional winner is disqualified, the Sponsor reserves the right to award the Prize to a reserve winner selected in the same manner, time permitting.

13) Prize Acceptance: Upon the Sponsor’s receipt of the Release Forms if required, notification to arrange fulfilment of a Prize will take place within twenty-eight (28) days of acceptance of thePrize. Any winner’s failure to comply with these procedures, or any other aspect of these Official Rules, shall automatically disqualify that winner from receiving a Prize. In the unlikely event that a winner has been notified that they are a verified winner but has not received communication to arrange theirPrize the winner must inform the Sponsor no later than August 31, 2024. If a winner does not do so, the Sponsor reserves the right to not reissue the Prize or limit its value at its sole discretion. Only emails sent for this specific purpose will receive a reply.

14) A winners list will be made available by the Sponsor 4 weeks after the close of the Promotion Period, for a period of 8 weeks.

15) Moderation: The Sponsor reserves the right to reject entries which, in the reasonable opinion of the Sponsor:

a. are in breach of the Official Rules;

b. contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Sponsor or any brand partner;

c. contains or refers to any unauthorized third-party brand or reference any third-party names, logos and/or trademarks;

d. promotes any political agenda.

16. Tax Obligations:

a. For US Winners of Sweepstakes Prizes, the fair market value of any Prize valued at or over USD $600 will be reported on IRS form 1099-misc and issued to the recipient. Tax identity information will be collected by completing IRS form W-9 for all winners of Prizes awarded which are valued at or over USD $600.

b. For Winners from all other participating countries, there may be additional or equivalent tax forms required to be issued based on the winner’s country of origin. Each winner shall be solely responsible for payment of any and all applicable local taxes for the Prize won.

c. Each Sweepstakes Winner from any participating country may be required to sign and return certain tax documentation. Where applicable, the Sponsor may require Winners to provide additional tax information, as required by law. Unless otherwise specified, theWinners will be responsible for any applicable taxes related to the acceptance of any Prize. Further, the Sponsor reserves the right to withhold any portion of a prize deemed necessary for compliance with tax withholding requirements, andto forward such portion to the applicable taxing authority on behalf of a prize recipient.

17) Failure of the Sponsor to enforce any term of these Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any Sweepstakes details contained in these Rules and the Sweepstakes details contained in any Sweepstakes materials (including, but not limited to, point of sale, television and print advertising, or any other Sweepstakes media), the details of the Sweepstakes as set forth in these Rules shall prevail. The Sponsor reserve the right to modify any aspect of the Sweepstakes, including theseRules, at their sole discretion.

18) LIMITATION OF LIABILITY: By participating in this Sweepstakes, entrants and winners agree that the Sponsor,Facebook, Instagram, Mark Blackburn and his management and related companies, any company whose products or services are named as prizes in these Rules, and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, fulfilment and marketing agencies, and website providers, together with each of their respective officers, directors, stockholders, employees, representatives, designees and agents (the “Released Parties”) are, to the extent permitted bylaw, not responsible for:

a. Lost, late, incomplete, stolen, misdirected, undeliverable e-mail notifications, or postal mail;

b. any computer, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability;

c. garbled, corrupt or jumbled transmissions, service provider/Internet/website/Use Net accessibility, availability or traffic congestion

d. any technical, mechanical, printing or typographical or other error;

e. the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information;

f. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Sweepstakes;

g. any property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Sweepstakes, or possession, acceptance and/or use or misuse of Prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action;

h. any and all international, federal, state and local taxes;

i. entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with the Rules; and

j. or any loss (including, without limitation, indirect, special or consequential loss, punitive or loss of profits), expense or damage which is suffered or sustained (whether or notarising from any person’s negligence) in connection with this Sweepstakes or accepting or using a Prize, except for any liability which cannot be excluded by law.

SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

19) Except where prohibited by law, by participating in the Sweepstakes, you grant to the Sponsor and its affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state/province/territory), social media handle(s), voice, biographical information, Social Media Entry, written or or a l statements regarding the Sweepstakes or Sponsor’s products/services, and if a winner of a virtual golf lesson prize, any footage/recordings Sponsor may obtain from your virtual golf lesson (collectively, the “Materials”), for advertising and promotional purposes in promoting or publicizing Sponsor, its affiliated companies, and the products or services of each, in any and all media without limitation as to time or territory, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of the Materials.

20) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW

21) The Sponsor seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Rules, your entries (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Sponsor reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Sponsor reserves the right at any point to:

a. Verify the eligibility of entrants and/or provisional winners by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.

b. Disqualify entries that are not made directly by the individual entering the Promotion.

c. Disqualify entries made using anonymous email services such as, but not limited to, Guerilla Mail, Dispostable or Mailinator.

d. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.

e. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.

f. Disqualify entrants who tamper with the entry process.

g. Disqualify entries which, in some other way, do not meet the requirements of these Official Rules.

h. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorized intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Sponsor which corruptor affect the administration, security, fairness, integrity or proper conduct of this Promotion.

22) The Prizes are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason a Prize and/or any element of a Prize is not available, the Sponsor reserves the right, at its sole discretion to substitute that Prize or element of the Prize for another of equal or greater value.

23) The Sponsor is not responsible for any undelivered messages or e-mails, including without limitation, e-mails that are not received because of an entrant’s privacy or spam filter settings that may divert any winner notification or other Sweepstakes related e-mail to a spam or junk folder.

24) No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Sponsor does not guarantee continuous or secure access to https://golf-cloud.rapsodo.com/ or any other website or Social Media Platform.

25) This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with the Social Media Platforms. You are providing your information to the Sponsor and not to the Social Media Platforms, and the Social Media Platforms are not responsible for any element of this Promotion. Any questions, comments or complaints regarding the Sweepstakes must be directed to the Sponsor and not to the Social Media Platforms.

26) By entering the Sweepstakes, each entrant agrees: (I) to be bound by these Rules, (ii) to waive any rights to claim ambiguity with respect to these Rules; (iii) to the extent permitted bylaw in their country of residence, to waive all of their rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Sweepstake; and (iv) to the extent permitted by law in their country of residence, to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Sweepstakes, including, but not limited to, any Sweepstakes-related activity or element thereof, participation or inability to participate in the Sweepstake;(b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defectsin, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or wilful misconduct in connection with the use of a Prize (or any component thereof); (d) any change in the Sweepstakes or prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g)lost, late, stolen, misdirected, damaged or destroyed prizing (or any element there of); or (h) the negligence or wilful misconduct by entrant.

27) If, for any reason, the Sweepstakes is not capable of running as planned, or the integrity and or feasibility of the Sweepstakes is severely undermined by any event beyond the control of the Sponsor, theSponsor will not be liable for any failure to comply with their obligations or any delay in performing their obligations with in these Rules if an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, earthquake, explosion, industrial dispute, war, terrorist activity, any federal, state, provincial or local government law, order, or regulation, order of any court or jurisdiction, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God or any other circumstances beyond the reasonable control of the Sponsor (each a“Force Majeure”event or occurrence).

29) If any part/s of these Rules are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

30) By entering, you will be deemed to have agreed to be bound by these Official Rules.

31) If there is a discrepancy between these Rules and those in any promotional material, these Rules will prevail.

32) Disputes; Governing Law. The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Rules and/or theSweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the state of Missouri, USA.

33) THESE RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MISSOURI WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.

For any matters which are not subject to arbitration as set forth in these Rules and/or in connection with the entering of any judgement on an arbitration award in connection with these Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in in the State of Missouri, USA nearest toChesterfield, Missouri USA. The parties agree not to raise the defense of forum non conveniens.
