RAPSODO LIMITED WARRANTY

Rapsodo, Inc. warrants that during the warranty period, it will, at its sole discretion, remedy defects free or charge either by 1) repairing or b) replacing or c) refunding the purchase price of the unit to the purchaser, subject to the terms and conditions of this Limited Warranty. Any replacement may be, at the option of Rapsodo, Inc., a new or remanufactured Product. This Limited Warranty is only valid and enforceable in the country of purchase unless local law stipulates otherwise. The warranty period starts at the date of the original purchase. Rapsodo, Inc. provides the following product warranties:

Rapsodo Baseball and Softball Hardware Products: (1) on-year limited warranty for the device (1 year = 12 months)

Rapsodo Mobile Launch Monitors (1) on-year limited warranty for the device (1 year = 12 months)

Exclusions and limitations: This limited warranty does not cover:

Normal wear and tear of the product;

Defects or damage caused to the product by misuse (contrary to intended or recommended use with the documentation), failure to use or properly assemble protective equipment (including but not limited to the protective cage included with PRO 3.0), accident (including without limitation collision, fire and the spillage of food or liquid), neglect, abuse, alteration, unusual stress, modification, improper or unauthorized repair, installation, wiring, or testing, improper storage, or if the serial number has been removed.

For the sake of clarity, misuse includes: device damaged after being hit by a ball, device damaged after being hit by a baseball bat, device falling off, device used under rain, water, or adverse weather exposure conditions.

Access to warranty service: You must have proof of purchase to access the Rapsodo warranty service. To obtain warranty service for any product that is subject to the foregoing warranty, you must notify Rapsodo, Inc. to obtain a Return Material Authorization (“RMA”). Rapsodo, Inc. will send you a label and detailed information about how and where to ship the product.

Use the provided label to return the defective product with proof of purchase to the below address (unless otherwise specified upon reception of the RMA):

Consumer shall bear the cost of shipping the product to Rapsodo, Inc. and Rapsodo Inc. shall bear the cost of shipping the product back to the consumer after the completion of service under this limited warranty. Any product returned to Rapsodo, Inc. without an RMA or without proof of purchase will be returned to the consumer at the consumer’s cost.

Limitation of liability: The limited warranty extends only to the consumer and is not assignable or transferable to any subsequent purchaser or user.

The limited warranty set forth above is provided in lieu of all other warranties and Rapsodo, Inc. hereby disclaims all other warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular use or purpose, non infringement, quality, and title. Rapsodo, Inc. does not warrant that the product is error-free or that it will function without interruption.

To the extent Rapsodo, Inc. may not, as a matter of applicable law, disclaim certain implied warranties, the duration of any such implied warranty shall be limited to the shorter of the one (1) year limited warranty period or the minimum time period permitted under such law. Some states do not allow limitations on the duration of implied warranties, so the above limitation may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

In no event will Rapsodo, Inc. be liable for any special, indirect, incidental, punitive, or consequential damages of any nature whatsoever including but not limited to loss of profits or revenues, loss of data, loss of use of the product, or any associated equipment, cost of any replacement goods or substitute equipment, loss of use during the period that the product is being repaired, claims of any third parties, or any other damages arising from Rapsodo, Inc.’ breach of this limited warranty or the use of the product, regardless of the form of action whether in contract, tort (including negligence) or any other legal or equitable theory, even if Rapsodo, Inc. has been advised of the possibility of such damages. In no event will Rapsodo, Inc.’s total cumulative liability exceed the price paid by the consumer for the product.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Rapsodo, Inc. offers a 30-day money-back guarantee on all hardware orders placed on our web-store. If you bought the product for your own private use as a consumer and want to exercise your right to cancel the contract and return the product, you can return it within thirty (30) calendar days after the date of receipt of the delivery. We do not refund membership subscriptions and the 30-day return policy does not apply to membership subscriptions. Please contact support@rapsodo.com for additional details. 

RESTOCKING FEES

A restocking fee of $300 will be applied to all returned baseball and softball products.

INTERFERENCE AND WATER EXPOSURE

Rapsodo hardware products are extremely sensitive and accurate data-tracking monitors. While Rapsodo hardware has been engineered to achieve accuracy within a regular baseball environment; many everyday items like electrical appliances, computers, cell phones, bulbs, and similar products may produce electrical or optical interference that can generate false readings. You need to be aware of these kind of products in the environment where Rapsodo Baseball is used, as they may cause interferences. One technique to test for interference is to make a measurement in the same direction with no object in motion and see if you get data results.

WASTE REGULATORY NOTICE

Your Rapsodo Monitor is not water-resistant. Do NOT use the device under rain, water exposure or wet environments, as the product may get damaged.

Regulatory notice Waste electrical and electronic equipment: The symbol on the product or its packaging signifies that this product has to be disposed of separately from ordinary household wastes at its end of life. Please kindly be aware that this is your responsibility to dispose of electronic equipment at recycling centers in order to help conserve natural resources. Each country in the European Union should have its collection centers for electrical and electronic equipment recycling. For information about your recycling drop-off point, please contact your local electrical and electronic equipment waste management authority. Do not dispose of the Rapsodo device with household waste. Batteries are not to be disposed of in municipal waste streams and require separate collection. Disposal of the packaging and your Rapsodo should be done in accordance with local regulations.
